Cancellation made after booking starts - No refund of the booking fee Notwithstanding anything, Ogonn reserves the proper to withhold any refunds thanks to cancellations, if Ogonn, at its sole discretion, perceives any mastercard frauds by a user or where cancellations are made by a user with an intention to defraud Ogonn. |

Discounts |
Discount is applicable all time of booking (if company offering that time) at the time of booking. Discount is applicable only on the booking fee after adjustment for credits (excluding refundable deposit, if any) paid beforehand to book the car or bike. Discount won't be applicable on blackout days. List of upcoming blackout days/peak seasons is here (Please make sure that you decide on your city to look at corresponding blackout days/peak season). Ogonn reserves the proper to cancel a booking if any unwarranted use of a reduction coupon is identified. |
Fuel Policy |
Free Fuel is simply remembered for the valuing for fuel appointments. Individuals could also be qualified for repayment of fuel costs upon the accommodation of a Bill containing the quantity of fuel filled, the date on which the fuel was purchased, and therefore the expense of the fuel. On account of No Fuel appointments, the vehicle need to be returned by the Member, upon the fulfillment of the booking, with fuel at an identical level as toward the start of the booking. Speed Governor |
The Vehicle could also be enabled with speed governor in compliance with the applicable Government regulations, which limits the speed of the Vehicle up to 80 km/h. you'll even be notified by SMS on your registered number. |
Breakdown of vehicle |
1. The Member shall be liable for the prices associated with the repair, recovery, and loss of use of any Ogonn vehicle resulting from any of the foregoing, up to the present damage fee, as set forth within the Fee Policy / Rate Schedule (if such costs are due to the fault of the Member or if the fault isn't directly established to the other person/ entity, or where any cost isn't paid/reimbursed by the insurer of Ogonn vehicles or the insurer of the opposite vehicle involved within the accident).
2. Where the Member isn't liable for the breakdown of the Ogonn vehicle, Ogonn shall refund an amount adequate to the value of the unused hours of such booking. Further, Ogonn shall not be responsible for any longer costs borne by the Member as a consequence of the breakdown of the Ogonn vehicle. |

- 1- Handover according to the first booking, extensions and modifications are subject to availability of the vehicle.
- 2- Your free KMs are calculated supported the newest scheduled devour time to the newest scheduled drop off time or to the particular drop off time whichever is later.
- 3- All Refunds made shall be through the first payment account only within 30 working days.
- 4- Ogonn reserves the proper to charge a fee for specific pre-defined accessories.
Also, an inventory of penalties will be levied if members violate certain Ogonn community rules.

Vehicle Damage (Intentional or Consequential) |
In case of any intentional damage or damage caused to the vehicle as a consequence of the member driving the vehicle, even after the vehicle is broken and wish urgent repair (Examples include but aren't limited to:
a. driving in water loggings resulting in engine breakdown,
b. driving after underbody damages resulting in engine breaks down due to oil drainage,
c. driving while under the influence of alcohol or other intoxicants,
d. driving with clutch over pressing etc. Members are going to be responsible for the complete cost of repair post damage to the vehicle + loss of expected revenue arising out of the damage. |

Note: Payments owed by members are going to be deducted from the safety deposit. If the safety deposit doesn't cover such payments, the balance must be paid by the member electronically.
Please note there are four cases where there'll be exceptions:
- In the event the member is found to be under the influence of alcohol during a booking, the member is going to be held responsible for 100% of the vehicle damage bill as per the invoice received from the vehicle workshop.
- The member is going to be responsible for 100% of the whole vehicle damage bill within the event that the vehicle workshop and/or insurance firm deems the damage to be consequential (this is going to be clearly stated within the accident report). Consequential damage occurs when the member continues driving even after an external vehicle impact, thereby severely undermining the condition of the vehicle.
- In the event a non-Ogonn member is found to be the one driving at the time of the accident, then the member is going to be held responsible for 100% of the vehicle damage bill as per the invoice received from the workshop.
- Not with standing anything to the contrary contained here in, only SUV vehicles are permitted for trips to regions having higher altitudes including but not limited to Leh or Ladakh districts in Jammu & Kashmir. Damages caused to the vehicles except falling under SUV (Ecosport, Scorpio, XUV, Tata Safari, Toyota Fortuner) category will attract charges viz; damages fees of ₹ 999 along with side repairs cost, towing cost, the travel cost of representatives of Ogonn, and other related charges if any on actual basis.
Member's Responsibility
If an Ogonn member is violating the law or Ogonn rules, for instance by overspeeding or driving drunk, the member is going to be liable for all damage, liability, and fines and will face action. Responsibility for Payment:
- Payments by Members shall be made with his/her MasterCard or open-end credit. The Member is under obligation to make sure that the account from which the amounts are to be collected has sufficient funds or credit available to hide any charges. Member is solely liable for any associated bank or MasterCard charges or fees. Member could also be charged a processing fee for a declined credit or open-end credit payment.
- In the event the Member defaults on any payments, Ogonn is entitled to charge reminder fees and default interest under the provisions of the law. additionally, Ogonn may utilize third parties to gather amounts owed to Ogonn by a Member.
- With all fees mentioned above, Ogonn reserves the proper to ban a Member from making a subsequent reservation until all outstanding fees within the Member's account are paid fully. within the event a fee is incurred, Members will receive an email invoice from Ogonn which will have detailed payment instructions.
Collision or other incidents:
- Ogonn provides full wrap unlimited third party insurance without a maximum cap.
- If a member is involved in an unintentional/non-consequential incident/accident (including but not limited to a collision or misuse of the vehicle) Member are going to be liable for a typical insurance deductible payment of up to ₹ 999. The members are going to be obligated to pay the repair cost up to ₹ 999. The payment owed is going to be deducted from the safety deposit, if any. Should the safety deposit not cover the payment (in the case the Member has accrued late return, excess km, etc charges) the balance of the payment owed shall be payable by the Member separately as a further outstanding..
- Members are going to be liable for all towing and impounding charges related to a collision.
- Members are going to be liable for all towing and impounding charges caused by member failure.
- Ogonn is going to be liable for all towing and impounding charges caused by vehicle failure.
- Member is going to be liable for all applicable damages and costs, including those in more than the applicable Damage Fee, arising from the Member's failure to suits the terms of the Agreement and/or a violation of the law.
Tolls:
- Members are liable for paying all tolls at the time they're due.
- Ogonn vehicles are registered with an All India Permit, allowing the vehicle to enter any state within the country.
- Members must pay all inter-state taxes and costs upon getting into a neighboring state. Ogonn shall reimburse the State entry fees only within the event when the Member pays for three months or more. By joining Ogonn, the Member agrees to pay Ogonn the prices, charges, fees, and expenses that began within the Agreement, including specifically and without limitation those set forth during this schedule. the subsequent isn't exhaustive and other specific fees, costs, and charges may apply. Other applicable costs are going to be communicated to the Member. Capitalized terms utilized in this schedule shall have an equivalent meaning assigned to such terms within the Agreement. Ogonn reserves the proper to vary the terms of this Policy from time to time and shall give notice of such changes to the Member during a timely manner. Notice to the Members shall be considered given when such notice is indicated and accessible from the primary page accessed after the Member log-on to the Ogonn website, or by email to the Member's email address provided to Ogonn within the Member's application or last provided to Ogonn. Member agrees that the amended terms and conditions of this Agreement shall be effective and binding the sooner of (1) the effective date indicated in such notice; or (2) on the date posted on Ogonn's website.

We may also derive your approximate location from your IP address.
- Contacts Information: If you permit the Ogonn app to access the address book on your device through the permission system used by your mobile platform, we may access and store names and contact information from your address book to facilitate social interactions through our Services and for other purposes described in this Statement or at the time of consent or collection.
- Transaction Information: We collect transaction details related to your use of our Services, including the type of service requested, date and time the service was provided, amount charged, distance traveled, and other related transaction details. Additionally, if someone uses your promo code, we may associate your name with that person.
- Usage and Preference Information: We collect information about how you and site visitors interact with our Services, preferences expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers. To learn more about these technologies.
- Device Information: We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and verions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
- Call and SMS Data : Our Services facilitate communications between Users and Drivers. In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message.
- Log Information: When you interact with the Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our Services.
Important Information About Platform Permissions
Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. The iOS platform will alert you the first time the Ogonn app wants permission to access certain types of data and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that the Ogonn app seeks before you first use the app, and your use of the app constitutes your consent. - If your employer uses one of our enterprise solutions, such as Ogonn for Business, we may receive information about you from your employer.
- When you request on demand services, our Drivers may provide us with a User rating after providing services to you.
- If you also interact with our Services in another capacity, for instance as a Driver or user of other apps we provide, we may combine or associate that information with information we have collected from you in your capacity as a User or rider.
Use of Information
We may use the information we collect about you to:
- Provide, maintain, and improve our Services, including, for example, to facilitate payments, send receipts, provide products and services you request (and send related information), develop new features, provide customer support to Users and Drivers, develop safety features, authenticate users, and send product updates and administrative messages;
- Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
- Send or facilitate communications (i) between you and a Driver, such as estimated times of arrival (ETAs), or (ii) between you and a contact of yours at your direction in connection with your use of certain features, such as referrals, invites, split fare requests, or ETA sharing;
- Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of Ogonn and other companies, where permissible and according to local applicable laws; and to process contest, sweepstake, or other promotion entries and fulfill any related awards;
- Personalize and improve the Services, including to provide or recommend features, content, social connections, referrals, and advertisements.
We may transfer the information described in this Statement to, and process and store it in, the United States and other countries, some of which may have less protective data protection laws than the region in which you reside. Where this is the case, we will take appropriate measures to protect your personal information in accordance with this Statement.

Company and Vendors Agreement
Subscription Pricing-
- Users may choose and enable to pay ₹000 Security deposit.
- Users are required to pay a security deposit to confirm their request for Ogonn Technology Subscription. Security deposit once paid, is non-refundable in case the user chooses to cancel the Ogonn Technology Subscription before delivery or if the user terminates without serving the notice period.
Eligibility-
- For a user to receive the vehicle, he must upload a clear copy of his valid Driving License issued by any Indian state, his PAN vehicled and Cancelled Cheque and Aadhar card. These documents will be validated by the Ogonn Technology team to determine the eligibility of the user.
Maintenance Policy –
Minimum Guarantee-
- If a subscriber lists an EV for minimum 20 days (including all weekends) on Ogonn Technology Subscription platform, he is eligible to receive a minimum guarantee of 25K per month
- It is hereby clarified that above is neither a promise to necessarily pay such amounts nor a guarantee of revenue on listing, but it is merely an undertaking by Ogonn Technology to use reasonable best efforts to provide the minimum guarantee amount to eligible subscribers as mentioned above.
Pay-out-
- Ogonn Technology pays after completion of every service.
Revenue Share-
Cancellation or Rescheduling a Subscription-
- Ogonn Technology reserves the right to cancel any Ogonn Technology Subscription at its sole discretion with only consequence to return the actual amount collected at the time of the creation of Ogonn Technology Subscription subject to the availability of the vehicle.
- Associate shall have the right to cancel or reschedule a Listing at any time prior to the Start Time of the Listing.
- Further, Associate shall have the right to extend the End Time of a Listing at any time during the Listing. After the Start Time of a Listing, requests for preponing the End Time shall be entertained at the sole discretion of Ogonn based on customer bookings being impacted.
- Charges as stipulated in section Other Charges may be applicable on cancellation or rescheduling of a Listing under certain conditions.
Accident Policy-
- In the event, the vehicle meets with an accident while in the possession of Ogonn customers, Ogonn shall inform the Associate of the same, and Ogonn customer will be responsible for getting the Vehicle repaired and bear all related costs if any condition Ogonn customer will not pay.Ogonn will be responsible for getting the Vehicle repaired and bear all related costs (net of insurance proceeds).
Referral Policy-

- There is a fair usage policy for kilometers driven during the program. The user can drive up to 4,000 km per month under this policy.
- The subscriber can't change the vehicle under the existing subscription agreement. In case, such a change is required, the subscriber will have to subscribe for a new vehicle through www.ogonn.in and the policies at that point in time would be applicable to for the new subscription.
Vendor Behaviour
- In connection with your use of or access to the Services you may not, and you agree that you will not, nor advocate, encourage, request, or assist any third party to:
- Harm or threaten to harm users of our community, including:
- stalk" or harass any other customer or associate of Ogonn community or collect or store any personally identifiable information about any other member or associate of Ogonn community other than for purposes of transacting as a Ogonn customer or associate in accordance with these Terms;
- Engage in physically or verbally abusive or threatening conduct;
- Use our Services to transmit, distribute, post, or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information, or credit, debit, calling card, or account numbers;
Service & Maintenance
- associate shall ensure the maintenance and upkeep of the Vehicle by ensuring the timely scheduled servicing and repair in the event of any puncture, breakdown (not owing to accident), or any other reasons at an authorized workshop for the vehicle make, at Associate's expense.
- In the event the Vehicle breaks down and needs maintenance repair work (not owing to an accident) while in possession of Ogonn or our customer, Ogonn shall inform Associate of the same and take the Vehicle to a workshop for repair. However, the cost of the repair shall be deducted from the amount payable to Associate.
- In the event any documents from the Vehicle are misplaced while the Vehicle is in possession of its customers, vendor shall be responsible for recovering the same or getting it replaced (and Ogonn agree to fully cooperate with vendor for the same).
TERMS OF USE
- This zap terms of use is an electronic document in terms of the information technology act, 2000 and rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the information technology act, 2000. Please read these terms of use carefully. Your use of zap panel, shall signify your acceptance of these terms of use and your agreement to be legally bound by the same.
